Mrs. Carter was cross examined by Colonel J. B. Hale with very little change in the direct examination.

The next witness was Jimmie Carter who was examined by E. B. Fields, attorney for the State:

I live west of Browning, am half-brother of Frank Carter and Sallie Carter is my aunt. On the morning of May 11th I was at Frank Carter’s and was standing in the door and saw a little girl coming up to the house crying and she said her little sister was there in the straw stack and Aunt Sallie sent me over to see what I could find. I saw a man harrowing around there and told him that a little girl had come to our house and said her little sister was in the straw stack and that her father and mother were way up yonder and I said, “let’s go and find them.” And he said, “No, let somebody else find them. Come up to the barn with me.” And he had me hold the horse while he went to the house. The woman was washing and I didn’t hold the team, but sat on the wagon box. And there had been shoveled dry dirt and mud over it. He says, “did the little girl say anything about her pa and ma?” and I says, “Yes, she said they are way up yonder in the road.” That was before I told him what the child had said about her father and mother. After he got to the house he sent a boy a little larger than me down, and the boy said that he told him to unhitch the team and saddle up a horse. And he started to unhitch the team. Aunt Sallie called me and I went back, and did not see him saddle the horse. I went back to the house and then me and the little girl went back to the stack and at first we couldn’t find anything and then we looked on the other side, and saw a white covering and lifted it up and saw a woman’s face. We went back to the house and then I got in a buggy with the Harvey boy and he let me out in the road and I went through the field and told Frank and went to town. I did not know at whose house I went where the straw stack was, nor did I know the man that I met in the field, but the house was straight east from Frank Carter’s and there was no other house between them. The man that was harrowing had a black mustache about a finger nail’s length. I went to John Gooch’s to tell him of the discovery and afterwards went to get Frank Carter. 6
